Michael Slager Jury Foreman Speaks Out On Mistrial In Walter Scott Shooting ... Thanx to TODAY




This posting will be Part 27 of the "Police Brutality" series of this journal/ blog. I followed this case thoroughly as it was in the worx, following everything in the trial I could, to closing arguments. Also, let me note here, that I dont put anything in this series UNLESS there is clear actual reason to question the force used or death. This is now old news, but wanted to eventually have this case recorded in this journal, because for one, it was about the worst case of injustice that I seen, in 2016 for sure. The other thing is, since this mistrial was handed down, I figure that this will probably be about the biggest case to come of this kind, this year in 2017 ... between the retrial and federal proceedings (federal juror selection scheduled to start May 1st) ... so it's going to be another mile long case this year, were just not hearing about this yet ... the news is sidetracked right now on other things, and folks preoccupied on things like Trump tweets and Oscar mistakes in Hollywood, etc. I wanted to open above with Jury Foreman, Dorsey Montgomery ... to have his say in what went down as far as with the jury ... then below, some added links to cover the shooting, arrest and indictment of Officer Slager, the trial, and what's happening post trial. I call this a murder case, instead of the voluntary manslaughter case that it was reduced to, because that is how I personally view it ... even though Walter Scott's familia and legal crew, say that they would have been satisfied with just a voluntary manslaughter conviction of 30 years, they trust in justice, God, and oppose the death penalty for Slager ... which is fine, that's what they choose ... I'm different, and dont count on much of that, and view justice today, as rusted.

The thing with the manslaughter case though, is it can be 30 years, but that doesnt mean that Slager would do 30 years, each state if different, not sure what South Carolina has as far as what qualifies as a penitentiary year, but in Texas, you're looking at about 6 to 7 months tops for a year, and there are other credits for doing things inside that are considered to merit time off too ... and this varies state to state, depending on much, including prison population reduction to budgets, so that can get a little tricky. Also, a Judge/ court worx on several recommendations from both defense and prosecution when imposing the sentence phase ... in other words, it can get partially or fully probated, or even come down to doing a flat 30. Federal time for instance, such as coming up in the other cases from the federal government is different, because it is day for day ... you get 10 ... you do 10, in federal time, eh? ... unless something odd comes up, like in some high profile or politically inspired case, where a governor, judge, or president jumps in (correction, you can get 54 days off per every year you serve in federal prison, based on good behaviour, due to sentencing reform, you have to do at least 85% of the sentence ... but I know 2 people personally, that had 10 year federal sentences, and served the entire 10 years day for day). Hopefully, for the sake of the familia of Scott, this will be much smoother in 2017 ... and the idea, that because of the settlement that they received, that this is some sort of justice, it's NOT, and money does not solve the mental anguish either, you just cant buy justice, any more than you can buy solid happiness, and that figure is greatly reduced with the fees to cover the legal end alone. Already, the defense of Slager, is saying that the government and people, are out to attack his client and wont be satisfied without prison, he is questioning also, double jeopardy, and saying that the ruling of mistrial should automatically be a barring of reprosecution, because it should be deemed as an acquittal, he questions video manipulation, and other things that will be presented in a new trial ... hope, but dont expect for this to be a cakewalk, and easy to get a conviction. In this new trial, which was supposed to be March 1st, but rescheduled for late August of 2017, can be even more complex. Maybe it's a good thing for Scott, because with the federal charges if found guilty of a couple ... it will secure some guilt for the later state case, I mean, you got 3 going in that, for deprivation of rights under color of law, justice obstruction, and use of weapon/ firearm in a violent crime ... a couple of them at least will be a plus, being before the state case. Because of the law and complexity, I see this as a mess, and hope I'm wrong ... I think you can get some kind of conviction, but not sure what they will work it down to. Even when they reduced it last year to voluntary manslaughter, it looked at least to me, that he would do some time, but a single juror holdout can ruin the whole thing, the trick is getting a unanimous jury ... otherwise it chips away the charge/ case ... and that can be difficult ... that's why I like to see the federal end get something first. It was plain difficult following law, and for the jury at first to have a mutual understanding between malice aforethought or heat of passion even, and the hours of testimony, deliberation, etc, all takes it's toll on a jury, mentally and physically ... no one knows that better than Slager's defense, and utilizes it. Of course you want a fair trial, but following law to decide, is what makes it difficult to get a conviction, that is why the defense of Slager will make it so complex, just like the first time ... jurors repeatedly had to request for terminology related to law ... it's a defensive designed smokescreen to trick you, but legal.

As far as the upcoming federal end of this, I'm expecting some obstacles in that too. And most of this will not change any time soon whether on the streets with cops or these trials and injustices, without retraining of officers, changes in policies concerning use of force, and legislation to secure it ... this can be achieved through strengthened public pressures. Slager's defense is already building a story of "fake news" to use on the federal case, saying that video from both the officers dashcam, as well as that of Feidin Santana, who filmed the shooting, has been pushed through media, to make the public opinion biased to his client (Slager), which impacts getting an impartial/ fair jury and trial. And using the fact, that there is no video of events between the dashcam and civilian video, just hearsay, ... although, the passenger of Scott is witness to some ... he was immediately detained, questioned and briefed in private by law enforcement, and released. Another obstacle, is being that this is under a new attorney general, as far as prosecution ... VP Mike Pence already has stated that this will all be in the hands of the "new" AG, which is true ... and the rest of the Trump crew been avoiding this ... and again, to me, this federal case is essential indirect precedent to the state criminal case later, as far as it's outcome, but that's just my view, I would hope to be wrong ... if the federal case does not go in Scott's favour. Slager will still use the self defense, life in danger, exercising training and law that he is "required" to, for his testimony, and by now, he already has that rehearsed with his defense, because it has to be as close to exact from the first state trial, or else it will be caught quick. I also expect Slager's defense, to push strongly to silence any talk in proceedings from prosecution, defense, and witness testimony, from being used in any of either trial, anything even related to statistics concerning everything from racial profiling to previous cases of even any questionable use of force or police brutality cases. The Slager defense argument, will be to stick to this case only ... that is all the law requires, and it is legal ... however, that same argument rarely worx for the dead victim, Scott, because they will try to highlight any prior cases he had, to sway jurors ... "avoiding" the same rule ... they sure as Hell did in the first trial, and this case should only be about this case as well ... this aint supposed to be a damn one- way street, when applying this rule, so the prosecution needs to point that out.

As far as my view of this case and murder of Scott ... the shooting was intentional to kill ... and NO, I dont buy Slager's previous testimony that his mind was like "spaghetti" and confused. Slager was not confused enough to utilize training and laws in place at the split second ... he was also not confused, when he appears to have picked up the taser from his shooting position after his target was down and relocate it to the victim, 40+ft away ... that is in question, as far as moving evidence, but pretty visible to me. He was also not too confused as far as falsifying anything in his initial report, that was all calculated, is how I see it. When you fire 8 shots at a running suspect, 5 hitting the suspect, and shots penetrating his back, you are shooting to kill, plain and simple. It doesnt even matter if you "thought" that he may grab that taser, or knocked it out of your hand ... the officer in that position is not in danger with a subject fleeing like that, at that distance. The initial stop of Scott at first, for me was clearly racial profiling, even by law, the stop was semi- illegal, if it was indeed for a "3rd brake light" out, by South Carolina law (Slate), in this case, besides Slager, maybe wanting to bring it to Scott's atencion, I dont think you can even write any citation in this case, I mean, by law, the brake light is in compliance. But, if the light was "reason", it wasnt reason to pull over Scott, assuming the law in place stands. Slager I know, has had other issues from citizen complaints before ... it's racial profiling to me, because you have 2 black subjects in a Mercedes, with custom tires and wheel rims, which is popular with young people, especially in urban areas. I point this out to young people all the time here in Dallas, about not dressing your car to to be a "giveaway" too much (besides, you have to worry about folks ripping off your rims too), cause cops profile vehicles before anything else ... they even actually profile as well on vehicles with dents from fender benders to possible/ probable cause, for driving under the influence stops. I also have to assume watching Slager's unit dashcam, that he already ran the plates before he stopped Scott, a standard procedure also ... being the way he approached the vehicle casually and patted the tail light, he was very comfortable (so no aggressive intention from Slager at that point, only after Scott made the break/ run). If the plates came back on the stolen sheet, he would have approached vehicle and subjects more cautiously and aggressively, and already would have his firearm in hand giving verbal orders to the driver from several feet back from the vehicle. There is also no reason in the citizen video for Slager to think that from that distance, that Scott was going to turn around and charge him, due to the way that Scott fled. Slager went back to his unit to run the license of Scott ... that may have been why Scott fled, fearing of being arrested for missed back child support, because that wouldnt have come up running the tags/ plates on the first search/ call ... that's why you run the license of the driver after the tags, to catch what it may have missed, and Scott knew this, if the driver has any wants/ warrants ... that gives cause to also run a check on the passenger, only after and if the driver comes back with warrants. We'll see what happens, I'm wishing Walter Scott's familia, justice and closure on this though.

The TOO TALL Texas Tale of TWO TALL Signs ... From Bald Mountain to Hollywood Hills Mount Lee ... The "Blistering History" Edition ... (TASTE OF TEXAS PT.30)

This posting will serve as Part 30 of the "Taste of Texas" series of this journal/ blog. The posting is to look at the decades old Dallas- Fort Worth area story about the "Welcome" sign on Bald Mountain (relocated from East Mountain) in Mineral Wells (Palo Pinto County), which is a local landmark for the small town of around 17,000, west of Fort Worth. And the other more popular sign, which is very well known worldwide, is the "Hollywood" sign, located on Mount Lee in the Hollywood Hills. The Bald Mountain sign in Mineral Wells, was put up in 1922, and the Mount Lee sign in LA, was put up in 1923 ... and they both have similarities when viewing from the ground at the base of them, which I've viewed both over the years in person myself. It was popular at a time (early 1900's), for many folks around the country to visit Mineral Wells, for the mineral spring waters, many from Hollywood as well ... more below in the links. But for years, as the story goes, folks have had reason to believe in Mineral Wells, that the "Welcome" sign in their little town, is what inspired the "Hollywood" sign that went up the year after ... the reasons also below. However, as you can see below, the story continues, and I dont think anyone will ever really know, so this is up to the viewer to decide, not me, I'm gonna stay outta this shit ... heh, heh, heh, heh, heh {:-)

SWEDEN'S "SWEET" RIOTS 2017: What Happens in Sweden, stays in Sweden ... A look at Sweden's "WHITE- GUILT" & "MULTICULTURAL DREAM" ... The "Cultural Clashes" Edition ... (HUMAN MORALITY PT.21)

This posting will serve as Part 21 of the "Human Morality" series of this journal/ blog. Parts of the postings title were inspired by the Las Vegas slogan "What happens in Vegas, stays in Vegas", and by the YouTube video below. What inspires the posting though, is the endless mainstream network primetime news over the last couple dayz here in America, on ABC, CBS, NBC and CNN, about how stupid President Trump is, talking about "what happened in Sweden last night" etc. Even Hollywood pop- culture personalities, and a host of other pop- culture so called "liberated and worldly" Americans, have made a 2 to 3 day spectacle out of this, and basically saying that there is NO problems in Sweden, the Swedish government saying no problems, and painting a picture of multicultural happiness and harmony ... I guess, you can call it "fake news", eh? heh, heh, heh, heh, heh {:-) I have read several news reports on this, and it is difficult to even find any non left/ right news, and absolutely incredible on the amount of political correctness, you have to actually go to right wing media, just to even hear the word "muslim" in most cases, sad, but true. Mostly all I hear, is that, they dont know who these people are rioting, they are all unidentifiable, they are immigrants, but who knows from where? People are being attacked in these EU countries, women are being sexually assaulted, citizens being mugged, riots breaking out ... and all by unidentified immigrants, that are mainly male, and this has been playing like a broken record in western European countries, for several years now. I have been asked locally by folks time and again over the years, why I vote democrat, am liberal on so many social issues ... yet dont like being categorized as an American liberal? ... well, this is a perfect example of why. Our political correctness, has become a culture of goofy stupidity, and to listen to Hollywood celebrities run their mouths while in their Beverly Hills mansions and neighbourhoods about what's going on, and who's at fault, is just as pointless to follow too, as much as politicians of Washington's left/ right establishment.

Since these incidents are all carried out by unidentifiable immigrants, I cant include this in the "Arab World Tensions" series, because I cant say this cultural clash is between Muslim immigrants and the native citizens of these countries, so it will go in the "Human Morality" series ... there certainly is a difference in "man- made" moral values, eh? But, in my personal view, much of this stems out of a culture of Islam, and differences with Swedish European culture, as far as the tensions in countries like Sweden ... and yes, I view religions as basically cultures, I dont see a goddamn thing spiritual about them. No doubt though, regardless of the news we are fed daily here in America, that none of this is happening, there are some real problems with the immigration flow coming into these countries, any way you slice it. I suppose this doesnt happen either, eh? I dont have a problem with folks that really are trying to avoid oppression and persecution in some of these countries, Syrians for example are going through some tough times, many would like to stay in Syria, but have to flee for their lives. When you come to ones country it's simple, you understand what is acceptable in that country. Example, if I went to a Arab Muslim country to live, I would have to abide by that culture and respect it, and in many, if I didnt, I may be imprisoned or executed. In America for example, our women should not be criticized or bothered, because of the way they dress or act for instance, or because they may enjoy having a drink/ alcohol ... our gay people, the same applies ... and our generational African Americans, are not to be insulted, especially by immigrants, who have no idea what they been through in this country since the start of it ... and yes, I have heard all this out of some immigrant Muslims personally. I feel the same way whether your religion is Christian, Muslim, Jew, or any other. I included some brief newsread below from the Toronto- Sun and Daily Mail ... and I found a pretty straight view on this from a citizen of Sweden on YouTube, to explain alot of this ... and Yes, although I may not agree with him on some things, I agree with him on much of this ... so Thanx to him on this.

This selection for this journal's music/ arts honour roll society, will be to showcase some of the work of the Laura Cox Band, out of Paris, France ... although when I first listened to some of Laura's playing on YouTube, I thought she was from Paris, Texas ... no doubt, you'd feel right at home down here in Hell's Ranch (Texas), Laura! {:-) Laura is a singer/ songwriter/ guitarist ... it appears, she started on a bass and decided to take up guitar, and started at around age 14 in 2005, started putting up videos on YouTube solo around 2008, and today has 47+ million views, and 200,000+ subscribers. She managed after just doing solo YouTube after awhile, to get a band together, it started with a good guitarist she met with similar tastes in music, Mat Albiac, after getting some work going together, and releasing their first single in 2014 called "Cowboys & Beer", they managed to bring on Francois on bass, and Antonin on drums, and then really get to work! The music falls into right now, the southern blues rock and classic rock, they add a fresh taste to it, and preserve well that style, but are also open to expanding into other styles in time. And Mat worx really well as far as for rhythm guitar too, blending with her work well, I believe his choice appears to be a Gibson SG, I seen Laura play various guitars, but I think her favourite is the Bacchus- Duke- Standard ... she also has a thing for Orange amplifiers, as far as getting the vintage sound she wants, and was endorsed by Orange amps ... which was a treat for her and the crew, she said. I was just introduced by a buddy to Orange amps in 2016, who told me to try it out one day (no, I'm not a guitarist, but enjoy messing around on guitars and various effects) ... I really liked it and the sound!

They mainly just been playing around France, but had got some good bills and offers to jump on as opening acts too, for well established industry names ... the big thing for them, is 10 march 2017, their first full album, "Hard Blues Shot", will be released on the Verycords label ... and Congratulations! Working and playing this genre of music at this time, in France only, does not bring in the demand as trendy pop music would, so, they look on being able to travel more to surrounding countries, and hopefully in the future, abroad. Much of the influence comes from the classic and southern rock, blues, country ... Laura was inspired much by her dad's music as a child. They are really a tight crew, and I like Laura's style, and she is a very versatile guitarist, just check out some of her other YouTube vidz, I like her slide work in there too! Below I chose a couple of their pieces, but I also wanted to throw in a couple old ZZ Top favourites, "La Grange" and "Just Got Paid", that they covered ... actually I would like to hear them do a cover of ZZ Top's "Beer Drinkers and Hell Raisers"! {:-) Also, because of Laura's talent and beauty, I wanted to add her in the "Beautiful Girlz" series of this journal ... and it's a real treat, refreshing that classic rock style that she gives on guitar and songwriting. Wishing her and the crew the best on their journey and music as well!

KHALID SHEIKH MOHAMMED: Letter to President Obama ... "TRUTH in TESTIMONY on TERROR & TYRANNY ... The "Newton's Third Law of Motion" Edition ... (ARAB WORLD TENSIONS PT.9)

This posting will serve as Part 9 of the "Arab World Tensions" series of this journal/ blog. It will be to view the letter of Khalid Sheikh Mohammed, that he wrote in 2015 to President Obama, while incarcerated at Guantanamo Bay Prison. But President Obama never received it until dayz before he left office in 2017 ... it was pending review they say, by the Pentagon's "reviewing authority" and considered "classified" ... newsread here from the "Miami Herald" ... also, credit here to Miami Herald for the piece. The letter for me, was just a compelling piece, that I was much in agreement with, and some not familiar with, so a surprise to me. I also feel like this should be given to President Trump, also the 435 members of the House of Representatives, and the 100 Senators to read as well ... and especially be in the public mainstream for American's to read and have some thought and conversation on. Much of what Khalid Sheikh Mohammed sayz ... I have thought for years and questioned, as far as our foreign policy, use of defense, and military/ political intervention and occupations, which I also write about throughout this series and blog, as far as my views. I cant say I know for fact that he did write this letter, but it is about as blunt and honest on the subject as you can get, which is a rarity in our politically correct corporate/ banking controlled society of today. As far as the guilt of this man orchestrating the 9/11 attacks, who is awaiting a death penalty trial ... if I was a juror, it would be difficult for me to be conclusive in a verdict of guilt ... being the amount of torture through waterboarding, deprivation, and degradation that he went through, it is hard to not break and say whatever under such interrogation. I also assume that one of the reasons that this case/ trial was avoided to be tried in a mainland U.S. criminal court, is because with all the torture and clear rights violations, that are against what our democracy and a fair trial should be, a defense lawyer would have so much to call out in a criminal court, and chance of getting a mistrial/ dismissal.

You dont have to be religious to understand this letter, as Khalid Sheikh Mohammed points out, you can use "Newton's Third Law of Motion", it's simply action and reaction, and the reality, condition, and result of war, oppression, tyranny, extreme greed, etc. I'm not Muslim or Christian, and never been religious in my entire life, in fact, my views clearly here on these institutionalized religions. I dont even read jihadist literature, I dont have much of anything culturally in common with these folks, anymore than I would with Christian fundamoralists (fundamentalists), in fact, culturally, I'm more like a segregationist ... and I never felt like we belong in these countries telling them what to do, anymore than they belong in our country telling us what to do. I'm as vulnerable as an American citizen to these terror attacks as anyone else ... something that our political loved ones in Washington, and their banks/ corporations that buy them, dont have to worry much about themselves. But enough from me on this. If the reader is able, try to set aside the left/ right duopoly politics, religion, petty bitch fights, corporate programming and such for a moment, and read this 18 page letter sent to the President below, and what in part motivates these attacks on the west, that we have to respond to, while most is just dictated by those at the top, for power, global territorial rule, and money. I think we can all learn something.

This posting will be for 2 series of this journal/ blog, "The Awakening" and "Public Patriots" series, an intro video above. The posting will be to highlight and honour Eugene Victor "Gene" Debs, for his contributions to standing up for American's rights, labour, and unionization as a union leader, also founder of the "Socialist Party of America", inspiring many, including great leaders of today, such as Senator Bernie Sanders. This is also a man who was ready to take whatever he was dealt by the courts/ government when it came to this, and his opposition to our war at the time, and served his time convicted and imprisoned for going against the grain, he was also a U.S. presidential candidate several times ... received 100's of 1000's of votes, and had a large following, making him a big threat to the establishment. So much of what he had to say a century ago, applies well to the times we are in currently, because it's the same old song and dance, as history repeats itself once again ... same shit, with new packaging is all. If we had stronger support and input in Congress from folks like Debs, or other socialists of that time, like Congressman Victor L. Berger, we would even probably be in better shape today than we are now. Socialism through controlled thought and propaganda is demonized, or looked at as an extreme, like old school Soviet communism. I'm not with any socialist party for instance, and seen much progress in capitalism, but realize that socialist ideas, have some positive points for a wider population. I have alwayz felt like some socialism can be a benefit to capitalism (as in 2nd paragraph here) ... I mean, there are several european countries that have socialism, and it did not shut down business and capitalism at all, nor did any of the social public programmes in America shut us down. We been programmed in a way through our political culture, to think if you're a capitalist, that all socialism is evil ... and if you're socialist, to think that all capitalism is evil.

I was at a private event here in Texas, not long back, that was alot of libertarian folks, and very politically outspoken/ opinionated, real pro- freedom with little government types. We had some different ideas as far as government, but soon found we agreed on so much ... we both loved the freedoms we do have, we both loved our 40 hour work weeks, overtime, benefits, and fair livable wages, we liked our social security plan, libraries, freeways, public parks, we all agreed that the corporatism is on steroids, and free market has been contaminated with too much monopoly in this age of "too big to fail", less options, with acquisitions and mergers galore, did not like pensions being replaced with these cleverly drafted plans to make you pay more and expect less, making peanuts for your investment, while paying folks you dont know, too much for managing it. Many things they, or even conservatives regard as part of what we expect and depend on, they didnt look at as "socialism", because it's such a frowned upon word, but as I explained to them, it actually is ... they just seen that as part of what we are entitled to, since we pay for it with our taxes and money, part of what our country should be about, simply. After some lengthy discussion we had, some came away with a different view of how they should label or view socialism, agreeing on much more than they thought they would. The ruling classes want to keep us at odds with each other, thinking and embracing left or right only, competing only for their benefit, they create much of the mess we have, not us ... they sure as Hell hate too much independence or freedom of speech and thought on our part, or finding common ground. China and Russia have also been on their list to conquer through neoliberalism, to have total control over them as they would here. The ruling classes of the west, created all our business dealings/ relations with them, as well as tensions with them countries, as they see fit, and wars with others.

Most folks have much more in common as far as goals and what our lives should consist of than we realize, regardless of what political party we embrace. The ruling classes alwayz do what they have alwayz done historically ... to keep ruling. Any progress or rights that people have got, has only been because the people alwayz had a counterpunch, and tossed a wrench into their machine gears, when most folks know they are getting stepped on too much by those at the top, so the ruling class are not your friend, or going to save you, they work more as an enemy if anything against you, unless you fight back. The resistance and awareness today is really doing great! ... and the response is global even. You can hardly go a month these dayz, without public resistance and disobedience from the people. Just 10 years ago, you hardly heard nothing about the corporatism, or what some of us see as corporate communism, the social and independent media is growing, and outraged more than a decade ago on our politics, the money in them, the 2 party duopoly establishment, the trade deals, the unfair markets, etc. Awareness is exploding these dayz, and gaining alot of ground, so much that those at the top are in fear, and have spent even more, just trying to control legislation, control more of the mainstream media, even building luxurious bunkers to hide in, if they need, heh, heh, heh, heh, heh {:-) To be constitutionally friendly, instead of attempting to use military force on American citizens by our own, they simple drafted some legislation through their flunkies in Washington, to militarize our police forces, and pay for it with our money and property seizure laws, they got more security now than ever ... they know damn well what to expect {:-)

The "ruling class machine", or what many folks label as "the elite", alwayz plan our societies, and are alwayz years ahead of the people, been like that for millennia. Opposition, disobedience, resistance in many forms have alwayz challenged them ... and that's the way it should be, if we didnt in this democracy of the U.S. for instance, we wouldnt even have a fraction of what we have now. As far as what our demands are, that is what's importante, not theirs ... look at it like a lawsuit ... you go in asking for $10 million, because you know, in the bargaining process, you will end up with $5 million, understand, these folks are alwayz open to negotiation and compromise, alwayz looking to make a deal. These ruling classes, do not have some special blood, or are chosen by some higher power, or needed by most people, and in my view, looking at them as some sort of special breed is dumb, or looking at them as elite is an injustice to the word, most couldnt even survive as well as working classes for that matter, if they were in the same situation. We know what they know for the most part where our future is going, we know that there is no longer going to be the need for jobs or labour as we had in the past, population growth as the past, or even a need for capitalism of the past. This is why we are milked now of everything, and these ruling classes are building their empires for a very different future. In the meantime, between now and then, we have to look at what worx for "us" and what dont ... idolizing, submitting, and kissing up to these folks wont gain you a damn thing. Eugene Debs proved that there is nothing to be afraid of by challenging them, and that challenge requires various methods, not just holding a sign up in protest ... unless you pound their asses good, they wont hear a damn thing you say. NFL CHEERLEADERS CLASS ACTION LAWSUIT 2017: Lawsuits alleging Conspiring Wage Theft ... Suing for Sue ... The "3 CHEERS 4 the Cheerleaders" Edition ... (AMERICAN JOBS PT.7)

This posting will be Part 7 of the "American Jobs" series of this journal/ blog. This posting will look at the class action lawsuit that came up against the NFL, even alleging conspiracy against the NFL as a whole, on everything from wage theft, to suppression of compensation and benefits, all in my view, way past due, so credit and cheers here for these cheerleaders for stepping up together, there has been individual lawsuits over the years, but I would hope this class action move will bring change, for those new younger cheerleaders ... they're suing for every other "Sue" too, is how I see it. But this can get complicated too, being that these are former cheerleaders pushing this action, in a complex hiring system ... like damn near every other business today, there are alot of parties involved, to lay responsibility on everyone else but themselves, you have the NFL, the individual teams, states, and cities, managements, the entertainment contractors, etc. When we watch these football games, and view the cheerleader squads, there is much that we dont see ... these are not just some women dancing, and much more complex than high school or college cheerleading, these professionals are also entertainers, athletes, as well as public relations specialists of sort themselves, not only on the field, but off. And yes, these businesses are guilty of all alleged in my view, there have been individual settlements reached in past for a reason, just like many of these large corporations, they dont mind shelling out a few million in a bind, when there is over a billion in profits on the line. Then to top it off, they try to nickel and dime them of what little pay they get, through fines, fees, and miscellaneous expenses that should be NFL/ team covered. A positive I read, was that California recently passed through some legislation, making these pro- cheerleaders ... "employees", and having to get at least minimum wage.

I worked with a gal for a year and a half, Kerri, who was also a Dallas Cowboys Cheerleader ... it was a new small graphic design and printing business with only about a dozen of us, her uncle who owned the business, brought her in after she been out of college about a year, to give her a job, she done sales on a commission basis, hustling up business, finding new customers, she would find jobs/ clients, I would plan and layout the jobs for press basically. I never realized how difficult it was to be a professional cheerleader, the competition, pay or anything about it ... so Kerri filled me in on alot about it. She had an obligation under contract, to do various fundraisers, conventions, childrens charity shows, etc. ... so she had a full time job it was like, just being on the squad, cause you're working off the field year round, not just football season. She actually loved her job being a Cowboys cheerleader, the workouts, discipline, rehearsals, etc ... she never had any complaints about it. What surprised me most, was when she told me what the pay was ... I had no idea, thinking that they were well compensated, and asked her what drives her to be in it? She told me, the challenge of making the squad with hundreds competing for it, and that it gives you a shot at other opportunities, you get television appearances, travel some, and she even got a couple little modeling gigs on the side in local fashion shows, so it worked out for her. They also have over 100+ different dances that they have to do on cue during that 3 hour game time, and intro performances, halftime ... maybe to rev the crowd, or for a score, depending on the situation. Several injuries can come up to, whether sprains, broken bones or related, the choreography is very detailed.

NFL cheerleaders are supposed to represent the team, NFL, and community wherever they are off the field, according to their contract, they are strict as far as how you carry yourself off the field too, so you have a full time image to present too ... from your speaking and personality to your everyday dressing, I assume that every team has their unique guidelines or conduct. Kerri once told me that she only was able to gain 2- 3 lbs at most, so they are strict on weight, which is understandable on weight, but it is very strict. The NFL is a multi- billion dollar business, all your players get decent pay, even if they just sit on the sidelines, your mascots get salaries and benefits as well ... the cheerleaders also do shoots for the calendars, posters and other merchandise, as well as do extra performances for charity or special events ... Cowboys cheerleaders have been alwayz in demand, and are one of the most popular crews. The money generated by the NFL is at all time highs, as far as all else it generates, and all the sponsors ... from alcohol sales to hospitality, to merchandising, it's a big money maker. This weekend for example, just on the Super Bowl game, a million folks will pour into Houston to watch the New England Patriots take on the Atlanta Falcons ... hotel rooms alone will go from the 100's of dollars to $5000 a night or so, entertainment venues will rake in a bunch, all the merchandise and memorabilia. Cheerleaders will have to make special performances, and day and night, and to also perform a choreographed set for the half time performers appearing, I believe Lady Gaga is the headline performer this year(?). They are doing alot to not get a fair share piece of the pie. This has went on too long as it is, and hopefully with enough pressure from veteran cheerleaders, it will inspire new cheerleaders to take action too, and make changes to how the NFL and their teams deal with these workers.
