First Interview With Democratic Candidate For Texas Governor ... Thanx to CBSDFW



This posting will serve as Part 1 of "Texas Gubernatorial Race 2018" for this journal/ blog. It will be to highlight Dallas businessman Jeffrey Payne, the first Democratic candidate to challenge Governor Greg Abbott for Governor of Texas, with an opening video above with Jeffrey. Many in Texas politics media, think that Abbott is a slam dunk win ... for me, you have not won ... until you won, eh? ... get out and vote, regardless of what they think or say! We have so many issues in Texas that are being ignored concerning our people ... instead, our governor has simply been focusing on things like bathroom bills and attacking women's health care needs. Also Abbott is strong for ignoring voters when it comes to fracking around their land, whether schools, homeowners or businesses ... example of this here, where Denton voters who voted no fracking around their property or town was ignored via Christi Craddick. Texas is a big state with big issues concerning Texans, so there is more to it besides simply religious pipe dreams and multinational corporate ass- kissing. The title of this post is just a twist of humour, since Jeffrey also won the title of "International Mr.Leather" back in 2009, and inspired by the 1939 classic "Mr. Smith Goes to Washington" movie. But someone needs to crack the whip in Austin today and get this state in shape for our future. Jeffrey lost his mom at age 3 and went to an orphanage, then to foster care at age 15. Jeffrey was living in New Orleans when Hurricane Katrina hit and it wiped him out basically ... coming to Dallas in 2005 with 2 dogs and $2000 bucks. Today, Jeffrey owns 5 businesses here ... a popular gay nightclub, a court reporting firm, a land holding company, property management company, and a retail clothing outlet. Jeffrey may be seen as a long shot by some, especially going up against Abbott's $40+ million for re- election ... but Jeffrey also has some advantages and makes some points on it in the "Texas Tribune" interview below ... hear the man out. After ... I will add some input of my own to this posting below.

I like seeing a person like Payne running for governor. Here you have a man with the grassroots of Americana written all over him. This guy was not some CEO or received wealth through inheritance. He was an orphan out of the trenches, been knocked down several times and is a small business success story. Texas was also good to him, he wants to serve the public in return ... simple. Of course a guy like Jeffrey Payne is a long shot here, and you can bet that much more popular known candidates with big money behind them will jump in. But Jeffrey is first up actually talking about the serious issues we have ... because Governor Abbott sure as Hell dont. Texas needs some new leadership, Payne realizes that Texans have many concerns that are not being addressed, whether it's education, women's and LGBT rights, small business, immigration, etc ... and Payne wants to capitalize on that, going one on one crisscrossing the state to meet with folks and discussing concerns that many in Austin are sweeping under the rug. Some will attack him based on the sexual orientation thing and creating fear propaganda, while hoping for those that are homophobic will come out to vote against him to strengthen that re- relection of Abbott. But you can also bet, that if they attack Payne too much on his being gay, it will get a backlash from many Texans as well, and cause anti- Abbott folks to retaliate even more, since Abbott has basically trampled on the LGBT communities of Texas. Abbott has like $41 million to run right now ... Jeffrey Payne is putting up at first $2.5 million of his own money, but you can bet that Payne will gain much more from donations. What Payne points out is a plus ... for one, he dont worry about the competition, slander, or the money ... he obviously had harder things to face through life, and was very successful business wise, he knows how to budget and spend well, he's proven it. But looking at what Jeffrey stands for, his roots and vision ... the philanthropic work he done helping other Texans and his compassion is something lacking currently in Texas. Payne understands business too obviously, and the support for small business is as importante as multinational corporate business.

As far as the issues ... Yes, education is a very big issue in Texas ... our current and last governor been focusing more on cutting schools funding, while trying to redirect spending/ funding more to fly- by- night profit driven education investors.  Trying to slow down the price of tuition increases for colleges/ universities also key importance. Abbott now sayz he wants to address taxes ... why now? ... neither Abbott or Perry, both republican, done nothing about the skyrocketing property taxation that is running rampant, housing/ real estate is moderate still by major states figures, but Texas has some of the highest property taxes in the country today. What are we going to do about the estimated 2.2 million undocumented Texans? (I think that there are more than 2.2 million). Well, just locking them up in privatized detention facilities and deportation is costing the taxpayers an arm and a leg as it is ... the detention center investors are making a fortune off it. Many of these undocumented folks been here working for years, and if they get deported, they're back at their jobs here in no time ... now is the time to make legislation to allow those like them to be considered for an easier and alternative paths to citizenship ... they're just as much a part of our Texas economy and our neighbours across the state. Medicaid expansion is needed badly ... however, under folks like Abbott ... he would actually refuse money from Washington that Washington OFFERS ... simply because he wanted to jump on the anti- Obama bandwagon out of popularity. This is especially importante as well for the disabled, kidz, our military veterans, elderly Texans, and to make sure that women have the health access and facilities needed ... Abbott is opposed to Planned Parenthood also out of stubbornness and the bandwagon cult mentality. I also support strongly, paid contraceptives/ birth control for our young people who may need help. This Bathroom Bill garbage is part of that same cult mentality ... where in Hell did this even come from? ... was it influenced by another state? We never had any bathroom issue here in Texas until these cult followers like Abbott created it ... it has also been a very anti- business type bill, since companies large and small are against it ... and it will cost the state millions or billions in business.

This political gerrymandering is a very serious issue here also in Texas that Payne points out, and like Payne sayz ... "gerrymandering is not democracy". This has been going on for years, and we have been shortchanged as far as our districts, representation and voices. I myself have called state representatives offices and signed petitions time and again concerning this and other issues such as women's health access recently. Texas House Bill 3859, that was not long ago signed by Abbott in the above link ... is also part of the cult mentality, it will clearly discriminate children, especially if they are LGBT ... Payne obviously knows what it's like to be a child up for adoption, Abbott dont. It places faith groups above all in placement of children up for adoption and rejecting or denying children fair access to families, education, services and medical needs that are LGBT kidz, or any kidz that they may not approve of or fits their tastes, while forcing a specific religion on them. The way I see this is to force feed a specific religious denomination and programme for children ... is this not similar to what Hitler done? ... I mean, what's next? ... special breeding for institutionalized cult upbringing? Texas is a very diverse state, and needs a more diverse leadership in Austin, than just the same old same. The population migration here from other states is incredible as well (CultureMap Dallas), highest numbers from California. Just one company (Toyota) recently started relocating several thousand and their families to Dallas from LA at 250 per week ... this is one of many large companies. Many others come on their own simply looking for opportunity and better living or other reasons. What I see happening here today, is what was happening in LA back in the 1960's. I credit much of this to the housing development explosion here and the rent and real estate increases. So there are many issues and needs to come as well ... this is why we need to focus on the future here instead of the past, and to accommodate all the new business and population. It's much more too as far as business than just mining or oil companies ... small businesses and new homeowners are key to the economy as well. But, wishing Jeffrey all the best running ... and I just know whoever I vote for will be the opponent of Greg Abbott, period ... and right now I'm throwing my support to Jeffrey Payne.

This posting will be for the "Poverty & Despair" and "SNAP Challenge" series of this journal/ blog. This is from the PBS series called "Chasing the Dream", so I wanted to highlight a couple pieces below ... and Thanx to PBS for their "straight up" work. But what you have is the big cuts to SNAP and much else that the Trump administration and majority republicans in Congress are pushing hard. I also want to focus on the reality here in America instead of the stereotype pop- culture about what food stamp recipients are about, that you may hear in talk in your communities or on the internet, many on the net basically pigeonholing recipients like a "one size fits all" type thing, basing everything on race, immigrants, dopers, lazies or whatever. Unless you have actually spent time in either poor inner city or backwoods rural communities and sat down with various people and dealt with them face to face, it is difficult to understand. The young lady Debbie in the above heading photo with her 3 daughters is not a lazy bumb or a doper ... Debbie worx her ass off, she has also 2 years of community college and had to drop out of Southern Arkansas University Tech before she could complete her associates degree in psychology to take care of her kidz ... hear her out in the newsread link below. Some video below that in another small Arkansas town on what they go through to get food. James Jackson in the video is straight up, this is a man who worked his whole life and is now in a tough spot ... he dont want to be in the situation he is ... I know his type. Randy Lindsey who owns the "Bottom Dollar Mercantile" store is speaking truth as far as how many hours he would have to cut his employees, and how they depend on SNAP for their small rural town business, as well as how many folks in town depend on that store to shop. These guys were also Trump supporters, who probably voted straight republican, and just voted that way in some desperate sense of euphoria ... listening to the "make America great again talk". Many of these folks may vote, but blindly and are very uniformed. Plus so many all over the nation in red state and rural areas were simply hustled. It's understandable to a degree, many folks didnt realize that they are listening to a top of the line hustler that played his game in the fastest hustling city in the country (NYC) ... this is a guy that could hustle the shirt off many of their backs. Trump selling his idea and himself, with what rehearsed seasoned politicians wont talk about. After the link read and video below, I will add some ... to cut through some of the bullshit and hustle to this, and talk about why it's importante to fight against these cuts.

Some folks may say ... "I dont live in a poor inner city or rural town area in the middle of nowhere ... I dont receive government assistance or food stamps (SNAP) ... why should I care?". I mean, I dont receive government assistance or SNAP myself or live in an inner city slum or out in rural America. But what is happening in these areas is happening in America ... if we dont take care of our own ... how in Hell can we help others globally? I'm an American, so the people of our nation are number one in my concerns, then others if I choose to after. I myself grew up as a kid hustling the streets, even stealing or whatever ... even slept on the subway and in movie theatres as a kid ... and later in life had the opportunity to spend time with folks in rural areas with values like those above. When I listen to this cleverly worded horseshit from Mick Mulvaney/ Director of Office of Management and Budget, run his mouth about they will now measure compassion by the number of people they get off assistance, etc ... all that is, is another sugar coating label to try to make themselves feel righteous about the shit they're pulling. The sales talk pitch they use, is that you cant help someone get out of a rut by making them dependent on you, that this is to "help" Americans ... yet they who say this in Washington and their multinational business depends on us. Bottom line in reality, corporate lobbyists dont design legislation to get people out of a rut ... in fact, the way they design everything in this country is to put folks in a rut, ripping off Americans, and lobbyists drafting legislation for Congress to pass ... so that our taxes go to them. The deal is again, looking out for our own, and many of these SOB's in Washington and their ratholed wealth constituency could give a shit less about the people of this country, unless it contributes to their material/ financial interests ... they ONLY look out for their interests and power globally. For decades, the whole design is simply to have Americans listen to them and spread our way and rules across the globe, look at America as like an extension of the Roman Empire, same shit, new package only ... the same type bunch is running it. We as tax payers and citizens give too much as it is as far as multinational interests with banks and corporations ... so much, it's become ridiculous, even from the most capitalist free market view. You keep letting these folks take, take and take ... you wont have a damn thing left. It's understandable and good business to give those who invest and even corporations a tax break and some incentives.  But what we have is nothing but an out of control robbery of America, with rules in the game changing by the month ... all dictated by the same trash.

The reason it's so importante to fight this using various methods, is because this is a slippery slope, to abolish and replace all that we have with corporate style communism ... it's not to strengthen us, but strengthen them ... and actually make us more "dependent" on them for our needs, and weakens our powers. They plan on cutting folks federal pensions even, or any bargaining rights of workers, Social Security, healthcare, property rights or whatever they can make a buck off of, all of what WE pay for. Do you see them cutting any of their treats? ... of course not. Frankly speaking for myself, I dont care if America is No#1 and that we have total control over the globe ... wont do most a damn bit of good, I dont worry about another country invading us, we are geographically large and have one Hell of a defense. Besides, all that "invasion" talk is nothing but talk ... we dont need billions more in nuclear missiles, you want more cyber defense, not nuclear defense. In fact with all the defense technology today, we wouldnt even need nuke weapons in any war ... and only have them to sell woof tickets to who ever else has them. Which one of these largest holders of global wealth actually wants a nuclear war? ... they dont want to destroy what makes their lives so good and their assets. And most of these mouth pieces in Washington or their corporate/ banking buddies wouldnt fight for this country ... we do that too. Many need to shut up for a change and listen to us, obviously they dont, so that is when we put the pressure on them. When we run out of money and worth ... they just look for the next country/ people to burn and gain power. Of course they have a vision for a future, but we need to make sure we have a sayso in it too. Either way you go, these folks are gonna do what they alwayz done ... so no reason to just give in to them. There is so much room for cuts in other giveawayz without driving corporations out of business. WE have needs too as people, and WE ARE what makes this machine work. What you have is folks managing our money and taxes (we're the consumers, producers) ... and telling us what our priority expenditures should be ... slow down a minute and think of how ridiculous that sounds. If someone came up to you on the street and asked you for all the money and credit/ debit cards you have in your pocket ... and told you they will spend and manage it for you ... you wouldnt turn it over to them ... you probably would look at them and say ... "who the fuck do you think you are?" ... that's the same attitude you should have with many of these folks that are out to only screw us.

SNAP for instance is such a positive for our economy ... not Russia, China, Indonesia or whatever ... OURS! We do plenty for other countries as it is, and our money made it possible for many to develop ... we consume so they can work and eat. Folks like President Trump, his daughter Ivanka, are having their products made for dirt cheap wages in places like Indonesia and China ... turn around and sell it with a skyrocket mark up percentage in high dollar American department stores or shoppes on Rodeo Drive (Beverly Hills/ LA), so they have no business (him or his daughter) running their goddamn mouth about bringing jobs in those production areas back to America ... without bringing their own shit back here. I mean, the Trump's can bring some of their jobs and production to Arkansas, they have moderate wages in Arkansas ... when you (Donald and Ivanka) bring your jobs back here, then you can highside or brag. The argument they will alwayz lay out is how broke we are ... were lacking funds because of their reckless spending of our tax dollars, not because were shelling out food stamps. SNAP is not only feeding those in need ... but keeping business going in communities coast to coast, all that money is being spent here and generating money here ... not abroad. It helps keep and create jobs, since Washington is so concerned about waste and creating jobs. They say people arent eating right and healthy ... that's where education comes in. They say some folks dont look hungry because they're obese ... that's because people that are low income, are choosing foods that fill them instead of eating healthy foods. Some of those foods, the same junk foods that you promote for business with your advertisements and lobbies in Washington, and who feed your campaigns. As far as the fraud ... take the video above as an example ... if these folks are trying to get a few extra food items or whatever ... I dont give a shit, their little grabs are nothing compared to what ya'll in Washington give out of our revenues. All this is for us, our people, many working and paying taxes themselves, here in the U.S. ... and the money stays here ... it dont disappear and end up in foreign offshore accounts. It keeps the peace, so that people dont have to steal to eat. The other argument is because of how many new recipients came on in the recession, and the recession is over. Markets are up and down faster, more financial fragility, with bigger hits, misses, acquisitions and mergers in todayz global economy ... a quicker here today, gone tomorrow type thing ... many jobs dont pay what they did, many are not coming back, and are not secure as they were in past, everyone is feeling the pinch, inflation, etc. NO ... I dont support cutting SNAP like this ... ya'll up there in Washington need to re- evaluate some of your special interests, earmarks, and foreign waste.

Slain Australian Woman's Father Demands Justice ... Thanx to Associated Press




This posting will serve as Part 30 of the "Police Brutality" series of this journal/ blog. It will be to look at the most recent murder of Justine Ruszczyk Damond, who went by the name of Justine Damond already, she was scheduled to be married to her fiance Don Damond next month. Justine was shot/ murdered by Minneapolis Police Officer Mohamed Noor, which was ruled a homicide by the medical examiner ... with shots fired at close range into Justine's abdomen, while talking to or approaching Officer Noor's partner who was driving at their cruise unit. The unit was cruising slow the alley with lights off, it could be that Noor, who was in passenger seat of unit, just freaked and panicked ... which would at minimal make a case for "involuntary manslaughter". The officers arrived to the call, which was a 911 call from Justine to report a possible assault from what I gathered, she was in the alley by her home in her pajamas when they got there, within 5 minutes of Justine's call to police, she was dead. Justine was a meditation, yoga and motivational type instructor as far as what she done for a career ... she also originally was schooled as a veterinary surgeon, and a positive role model in the community to many. She been here in Minneapolis for a few years, originally from Sydney, Australia. I opened above with video from her dad, John Ruszczyk, which I thought was appropriate to open with. My heart goes out to her dad and familia ... I myself would be heartbroken, but I know after my tears dry the next day, I would be focused and hungry on wanting Officer Noor's ass one way or another. I included some newsread with links from Sydney and Minneapolis and police dispatch audio from Heavy.com. Also ABC News video this morning with Minneapolis Mayor Betsy Hodges and her input ... Mayor Hodges not long back was so proud of Officer Noor as you can see here (Betsy Hodges Facebook), Noor being the first Somali immigrant police officer in Minneapolis. Many angry folks feel Officer Noor should at least make a public statement, he also refused to give a statement to investigators ... he dont have to by law, he's exercising his 5th Amendment right. As I was pointing out throughout this series, such as in Part 29 last week, the way we handle these cases will only result in an increase of deaths, and that no one will be exempt from this in time ... as you can see in this case. In 2016 alone ... over 960 people in the U.S. were killed by police (Washington Post | police shooting database 2016). After below, since Mayor Hodges is so confused and asking for answers along with thousands of concerned people ... I will add my part, cut through all the bullshit, explain the problem and how to fix the problem quickly and much more efficiently.

Although this investigation is only in the preliminary stages and everyone is asking questions and anxious to get answers ... the bottom line is you have an unarmed citizen who called police for help and she was executed 4 minutes after her call by the police that responded to the call. I'm as much in the dark on Justine's case as anyone, but I'm not in the dark as far as what feeds this condition and culture we have. And many of these cases you never get answers in America, but instead, a line of excuses for abuses, from the police leaders and the politicians. One may wonder, why in Hell would I toss politicians into this? It's because they are a key factor in the problem with this country and our cities when it comes to this issue ... and frankly, just about every other issue we have, whether it's healthcare, predatory finance, environmental, drug laws/ policies for legal and illegal drugs, rehab/ prevention/ counseling, unnecessary and mandatory mass incarceration, gentrification, wars ... you name it. I mean, how can we solely blame this on the police, when they are legislated by law to do this ... and forced into non- transparency and secrecy by their unions and political leaders to continue this culture? This makes it bad not only for our citizens, but the vast majority of good cops that are out there and doing a great job. When I myself talk to people one on one here in my town ... and tell them all you have to do is make legislation to change deadly force policies, mandatory changes in training and actually holding those accountable for their criminal actions with punishment ... many people just look surprised, as if they never heard that or thinking it's that simple, but that's exactly how simple it is. I mean ... who wrote these laws and rules, eh? ... it's not like they just miraculously appeared in stone, eh? Instead, these politicians from local on up fiddle faddle around trying to sugar coat things, and try to find wayz to change things without firm solid action ... so you end up with this.

Mayor Hodges looks mystified, she tried to do everything she can pushing for body cameras, new training etc, which is good. But the problem is ... that records show in Minneapolis since body cameras were in use, that you may only have a camera actually turned on by an officer for maybe 5 to 10 hours at most for the entire month, why has she ignored this and supported requirements so soft with too many back doors? ... it's not firm. Politicians talk about being tough on crime, but are not tough on cops, politicians, bankers and corporations that commit crimes. When cops refuse to turn on their cameras, you reprimand them or even terminate them. We went through similar in Baltimore for example with Mayor Catherine Pugh pledging in her campaign to crack down on police abuse of citizens, do this, do that, etc. As Mayor of Baltimore she has went against everything she pledged to do, not just on the police accountability situation, but every promise to improve communities, and even bucked the minimum wage increase that she campaigned on when it came to her desk to sign as mayor. Both Hodges and Pugh are examples of weak leadership on the local level. So the problems in America for citizens as well as police worsen, and you have to protect those good cops that want to change this and speak out about it ... not lecture and threaten them behind closed doors. It is our job as citizens to make sure we have a democracy, instead of what looks more like to me a culture and institution of fear ... there is a severe lack of transparency also, this needs to be forced out. I can only imagine what kind of excuses they will come up for this killing ... they work with their best lawyers behind the scenes on devising something, and to burn as much time as they can on these. I know I'll be following this and several other cases.

I took time to listen to folks at the memorial for Justine, many neighbours, friends and associates, who simply said they dont understand why this happened, but admitted that they know nothing about how the laws work or accountability. These are folks not in some poverty stricken neighbourhood with police on every corner or high crime ... these are middle income folks living in a moderately more laid back community. Now with this experience, many of these people are facing the reality that so many poor and people of colour have to face daily when they leave their home or call for police help. This incident where an innocent unarmed citizen who called police, and got gunned downed by the police that responded to the call, is not even rare in America, I have seen and read case after case of this over the last several years, most are swept under the rug and heard nothing about in the mainstream media, back door deals made, etc. Justine's case came to light in all mainstream media the last couple dayz, because she didnt fit the stereotype of the kind of people that get killed in this manner. What they need to do also, is actually start charging these officers, Officer Noor has already had multiple complaints just in his 2 years as an officer, even under federal investigation for forcing his way into a woman's home and physical abuse. When you have a history of abuse and violence as an officer, it should be dealt with immediately, when you sweep it under the rug, it inspires other officers with issues to think they can get away with it. Officer Noor, like Officer Oliver in our local case of the Jordan Edwards teen murdered in the Dallas area, both had a history of multiple cases of abuse and physical aggression towards women.

In Dallas for example on the Jordan Edwards murder by suburban Balch Springs Police Officer Oliver in April, Balch Springs Police Chief Haber gave no paid administrative leave to Oliver, he immediately fired him, and Dallas County District Attorney Faith Johnson, immediately charged and jailed Oliver without going through the grand jury route, the same as they do with any citizen where they have clear evidence and probable cause to charge a person with murder, and yesterday a Dallas County grand jury indicted Oliver to make it solid (NBC5DFW) ... things move a little faster in Dallas though, than Baltimore or Minneapolis ... but that's how you do it. You also have increased pressure from police leaders, unions, courts and politicians local on up the chain, to try to suppress murder convictions and sentences on officers in America ... why? ... is because once an actual conviction and sentence is handed down, it stays on the law books and lays precedent like any case to be able to use in other indictments and trials of officers in the future. So I hope that in Justine's case, her supporters will go after legislators and put their balls to the wall with pressure, and even would help if the Australian government got involved on this one. Dont believe that you cant change this culture ... that is another myth of despair and fear that only breeds weakness ... it's just a matter of solidarity and pressure. Already groups like Brand New Congress even have candidates lining up to replace existing politicians from the local level to the Washington level in both parties as early as 2018 who will NOT take corporate money ... the wealth is what is flooding this culture financially and feeding it, and not just in America. Just because the US Supreme Court sayz that major banks, corporations and their associates can flood our elections with unlimited money ... doesnt mean you have to take it, and there are many who will not.

STOPPED BY POLICE IN AMERICA? ... Tips for GAIN in the GAME ... and to Avoid PAIN when being DETAINED ... The "NO Fight or NO Flight" Edition ... (POLICE BRUTALITY PT.29)- (CITATION VIOLATION NATION PT.14)

This posting will serve the "Police Brutality" and "Citation Violation Nation" series of this journal/ blog. It will focus on what to do if you are pulled over by police, detained, etc, for criminal and citation type stops, offenses and questioning, armed or unarmed on foot or in a vehicle ... instead of highlighting one specific case and individual. Texas you can carry a gun in your motor vehicle or watercraft WITHOUT a gun carry permit (SmartGunLaws). The reason for the post is because of the current tensions, excessive force, deaths, and those I've talked to here in my community and neighbourhood, several that are young people that are not that well informed on law or their rights who asked me a few questions, etc. Another reason, is because I seen a growing amount of videos on YouTube for example that are advocating for especially young people to take more of a "libertarian" or "sovereign citizen" type approach when dealing with police that stopped you in a vehicle or on foot it seemed to me, which I DO NOT recommend, that is not wisest, especially in urban America. But I'll explain that when I add my part after the 2 videos below and link to read as far as a safer approach ... the NOLO link is very importante to read too. You may think that it's a shame that we would have to know all this in a country that prides itself on things like freedom, democracy, justice, and innocent until proven guilty ... but understand ... this is the current reality in America, and tensions between citizens and law enforcement agencies are increasing like never before in my lifetime (I'm age 61). Until you have legislators (politicians) state, federal and the courts change use of force policies (deadly and otherwise) and officers training in this country, and actual justice/ convictions for the few bad cops served ... we will have many more dead citizens and officers, and maybe even a few politicians. What you know and how you deal with these things on the street right now can save lives, deescalate tensions, miseries, and injuries to the citizen and the officer. Some video I seen on YouTube giving advice on what to do when stopped or detained is straight up dumb and an invitation to escalate tensions or even get an asswhipping if you run across the wrong cop. I also hear from folks all the time, that "profiling" (usually in the case of race) is illegal ... sure, it's law on paper, but dont count on that ... that is basically only good in the court for defense ... dont mean shit on the street. I dont see how you can even survive long on the street whether you are a cop or a criminal without profiling ... like even an animal in the jungle or forest needs to profile to survive. A cop is alwayz profiling on the street, what a person wears/ how they dress, their tattoos, personal hygiene, their walk, their driving, the vehicle and condition of the vehicle, if the vehicle is in compliance, etc. Look at it like any other 8 to 5 job/ occupation with job requirements and responsibilities ... their job is to enforce laws, serve the public and to keep the peace. Sure, it is good to know and exercise your rights, but sometimes it's better to exercise them in the court ... I mean, I exercise every right I can. I see folks in the heat of the moment start yelling at cops that they have rights and know their rights, etc, etc ... that dont even know their rights off hand if the cop were to ask them ... know your rights before you jump with them, be polite as possible, and dont volunteer information you dont need to. A teen (Santos) I know here in the neighbourhood told me that a cop cant do this or that because of your rights. I asked Santos what the 4th Amendment was, he didnt know, I then asked him for the 5th, 3rd, he didnt know ... I asked him if he knew the "Our Father" or "Hail Mary" prayer? (knowing he's from a catholic latino familia and looking at the gold cross on a gold chain around his neck) ... he looked confused and said he knows the prayers ... I told him to learn the Bill of Rights first up, it will do you more good as far as law and liberties than any prayer. Even if a cop is a little on the edge and had a bad day or whatever, dont try to feed it or push the cop. If you dont get your rights right there, let it ride and chill ... use them in court or any legal proceedings later that you pursue. Do not run your mouth about ... "I'm gonna sue you!", "do this or that!" etc ... get released from the detainment situation, then if you have legal grounds and reason ... act on them ASAP, not talk ... dont let the cop see you coming or threaten them talking about what you will do, just do it ... later.

When you are being pulled over or just stopped on the street walking to be questioned, you are usually by yourself, or with a friend or two ... understand, it is not like at a public gathering, demonstration/ protest where cops have that crowd control detail with dozens or hundreds of witnesses around ... the detail (job duties) of the cop is different. Stop at the officer's request as soon as you can, if night and you can find a more lighted area, or an area with people even better. Face the officer eye to eye when talking, dont keep looking away, the cop will sense you are trying to hide something. Relax and try not to be nervous, if you're nervous, a cop can make that quicker than anyone from experience ... and if you are nervous, that makes the cop nervous. Answer questions the best you can with as little words as you can ... the objective is to satisfy the officer's questioning and to move on ASAP, so that the officer can get on to doing his/ her job and finishing up their shift, and you to get on with what you need to do ... DO NOT waste the officers time ... and most importantly, DO NOT waste your time. One of the most importante things also if in a vehicle, is making sure your hands are visible to the officer at all times, as I was explaining to a couple neighbours the other day, both about 20 years old (Gabriel and his buddy Miguel) who asked me why is that so importante if you are in your vehicle, being your vehicle is your property? You are out on the public street in that vehicle, and it doesnt matter if on the street or with officers in your own home for that matter, when an officer is at a call or stop and there is question as to violation of any laws, he has to see what a person is doing with their hands, it's for not only the officers safety as far as weapons, but importantly for your safety too. Do not have your hands in your pockets, or especially in the back of your waist/ pants, leave them at ease at your side. Many folks try to act casual when standing, putting their hand or thumb on/ in their pocket to use their fingers to try to slip out illegal drugs while talking to the officer and flick them away, looking the officer eye to eye and talking to distract them ... the cop knows this better than you, and knows most the tricks for that matter, what they dont know that may be a new trick, they get briefed on in a later roll call. Never use the same trick repetitiously (over and over), or tricks you hear about in street or jailhouse talk, you will get made ... at least be creative. If you have pending warrants, assume/ expect that they already know when they either ran your tags, or when they run your ID/ license ... accept you got busted and utilize the courts and laws, dont contest the cops on the spot ... the officer is not a court.

In some cases regardless of what any law sayz which varies from state to state, county to county, etc ... assume that a cop will search you and alwayz expect it if you are in a high crime area, driving late night from a nightclub or even from work. Most people will not question a search, and the cops know this, is why they flex search methods and standards, but you do not have to consent to it. There is a chance depending on the kind of suspicion of the officer and if the officer feels probable cause, that they will also call in other officers/ units or even K-9 (dog) to search or back them. You can protest it ... but if they have cause they'll proceed, dont volunteer info pertaining to it, besides your verbal decline that once and chill. If you're lucky and have witnesses or recording, etc of rights violations in question ... take care of it later. You can ask the officer if you're free to go, they will let you know. If you have LEGAL prescription drugs on you or vehicle anywhere in America, they MUST be in the script bottle with your ID/ license matching name on bottle/ package ... if not they will make the bust/ charge you, and you will have to go to jail, make bond, and prove it in a court at a later date that they're legal. Cell phone searches, it's a hit and miss thing and depends on the stop and cop, one court sayz one thing, another court something else. When  arrested/ detained under suspicion of a crime, they will most likely search it ... if you get taken in to jail, they are almost certain to look at it when checking in your property as well as going through everything you have thoroughly from your hat down to your shoes, expect it ... dont get the red-ass (angry). If the stop is suspicion of drug transactions such as in a known drug area ... they will search your phone immediately hoping to score on messages you sent or received, they cross check names on their lists and codes used for delivery/ transport they got from other busts. That is why so many dealing in dope use throwaway no contract phones, flip phones, etc, and delete everything right after they used it, and they keep their smart phones out of it and separate from their deal phone ... if they are "smart" themselves. Cops learn just as much shit now from searching phones, than what they can get from a computer check/ run in their unit ... be aware of this, and what you store and do on your phone, and the type of phone that you use for what.

Recently another young man here in Dallas (Felix) who is 16 and on summer break from school and just got his drivers license ... asked me since we have marijuana laws in Dallas (and that is Dallas County ONLY in the DFW Metroplex) that allow you to have up to a quarter pound of marijuana without being charged/ arrested, can he and his girlfriend just sit in the car parked and chill, smoke a joint, etc? Felix said he dont like to smoke at home, because his dad aint cool with it, and worries that if he did, his dad may be questioned, or it may get his dad in trouble because his dad dont have papers (from Mexico). My advice is this, regardless of the law to have up to 4 ounces, etc ... still try to keep any public smoking of pot on the low if you can, cops look at parked cars and even run tags, lots of abandoned stolen cars and car break- ins. If Felix happens to be questioned by a passing officer who may be just passing making rounds randomly and the officer spots Felix and his girlfriend, he could stop and question them, even if the car is not running. Felix being 16, means the cop can insist on contacting his parent(s) ... therefore this would bring contact with his dad and the officer anywayz ... try to keep it on the low. You also dont want to take any chances on losing your license right after you just got it. Also, these states that have recreational marijuana legalized ... be aware that there are already tests that they can give drivers to read marijuana THC levels, or other drugs like meth, cocaine, or even legal opiates in your system on the spot ... San Diego (CA) and other states/ cities are currently using this one (San Diego Union- Tribune), and you should have expected this ... I mean, once they legalize recreational pot, they are going to be testing left and right to see if you have it in you, and have a list of other violations to get you on. In Texas you CANNOT buy marijuana legally, starting September 1st of this year, you will be able to get medicinal marijuana with low THC levels only legally with heavy restrictions (KSAT/ San Antonio). When it comes to suspicion of drunk driving in Dallas, people say you can refuse the test and/ or breathalyzer ... sure you can, but if you do, they can also take your license on the spot and detain you to take you in for a blood test, so my advice is to take the Field Sobriety Test (FindLaw) ... a better chance of passing that than a blood test if you're sharp.

When/ if you are informed that you are arrested, there is a chance they wont read your Miranda rights to you there if it's a low level felony or misdemeanor, you can request that they give them to you verbally ... when it comes to the "waiver part", I suggest that you say that you "heard" the rights ... however, dont say you "understand" the rights, and that you need counsel before you can say anything else ... you will also receive more rights from a judge after booking at your court arraignment. Another thing, cops will use all kinds of talk to try to get you to talk more or consent, as the classic ... "if you're not guilty or have anything to hide" pitch, or "admit and tell the truth and I'll be straight with you" pitch ... NEVER admit to a crime without counsel, and court/ DA deal. DO NOT fall for it, unless you actually feel you need to talk or feel if you do they may cut you some slack on charges, there is so many trick lines they use, too many to list here ... but if you dont know your shit, dont go there. Feel free to simply remain silent and politely say you're sorry and cannot talk any further. When getting handcuffed, it is most importante to let your arms relax and do exactly what the officer sayz when applying them, the officer will move your arms the way he needs to, leave them totally relaxed. Twisting your arm in discomfort can make it worse, or can be mistaken for resisting, and can result in another charge, if it hurts or too tight, simply inform the officer, and they will usually be easier ... do not resist at that point, some resistance can technically fall into assault category towards an officer ... look at it like using coupons at the supermarket, they have many laws (coupons) and their codes memorized, and will use all they can making an arrest. Do not fight or go into flight and try to run, chances of getting away are very slim, they have more tools and units to apprehend than you have wayz to get away ... take your fall, shut up, and take care of it later in the courts with counsel ... then you lay what you need on them later. Dont fall for the talk that they will make it easier on you in court if you talk, the cops have nothing to do with the courts unless they are summoned to the trial phase, anymore than the courts have anything to do with the prison/ jail you're sent to and their rules, or the rules of the probation/ parole departments, they all do their separate work and pass one to the other ... you're simply on like an assembly line, and can deal with each individually, use "your tools and rights wisely" and deal with all agencies individually. This entry for the music/ arts honour roll society of this journal/ blog is to highlight Frank Zappa (wikipedia), originally out of Baltimore and settled in LA, who I been intending to be in here for some time ... so glad to get to it! Frank is also one of the top all time rock music icons ... even though I never categorized Frank solely as rock genre, nor I doubt he even gave much thought of where he falls into. But, I also wanted to include Frank in the "Public Patriots" series as well, the reason primarily is because of the thousands of young people over the years that he registered to vote and how he pushed that issue so much, even on his albums. I myself was anxious to vote when I turned 18, so I never had anyone inspire me to vote that I can recall. However, I should have listened to Frank on politics when I was young, because I voted blindly and didnt look in depth to who I was voting for, beyond their campaign speech or popularity ... I was young {:-) Frank was very political and followed much, kept up with all the news, knew early on how to read between the lines and really stood up as even a sort of constitutionalist, he was more into it than most in the music industry that I seen. Frank because of his music status and influence, was able to debate his stand on major media such as CNN, Larry King, Charlie Rose and various programmes and speaking out on Capitalism Hill (Capitol Hill), and inspiring many more to ... so what he had to say and stand for really got exposure. And there is much of Frank talking about these issues foreign and domestic on YouTube, but I just chose a couple short snips below to include. Frank went up against folks such as PMRC (Parents Music Resource Center) because he made/ seen the slippery slope that it was leaning towards quickly, and even warned of how fundamentalism (what I call fundamoralism) was a growing concern and attack on our rights. This is a lesson we can all learn to stay on guard about, you dont want to lose any liberty you have.

Frank went out of his way with his busy schedule to bring awareness to so many that didnt know what was going on, he did this without the social media and tools of today, he would be Hell today, especially seeing what we have went to politically. When I was younger, I never expected some fundamoralist attempt to take over the country ... therefore not giving it much thought, after all ... I lived a fairly liberated lifestyle doing what I wanted, and ignored so much as long as it wasnt in my face. Frank went after folks like Pat Robertson, Ronald Reagan and George H.W. Bush, because he seen things that many of us missed. Frank even talked about things like how our country is moving towards a type of Fascist Theocracy, some folks may have thought of his talk back then in the 80's as conspiracy type talk, but what I see today is like a semi- puritanical type society as it is. It was hard to make the usual attack on Frank by many, because he didnt fit into their stereotype of rock star musician, he didnt smash up hotel rooms, he didnt use any drugs or alcohol and was a family man with 4 children, was an entrepreneur, very pro- business, and knew what he was talking about ... and the thing they hated most was his honesty. Today, both parties have been pushed by money to lean right more and more, making now democrats that are not liberal and having to move right to appease the big money as being worthy to stand against the far right. Republicans these dayz are more about incorporating corporate communism and theology into government and have lost real conservative values on everything that applies to straight balanced business and market ... and peddling dime a dozen vending machine type corporatism and religious evangelism. So to me we just have 2 carefully engineered right wing parties that are neither liberal or conservative, but instead being just one large party of neoliberalism.

Frank himself has made over 60 albums, and when you count the additional posthumous albums since 1994 from the Zappa Family Trust, there are over 100. I also give much credit to his wife Gail in this operation and handling so much of the business end, making it so Frank could spend much more of his time in the studio. Gail was a secretary at the world famous Whisky- a- Go Go in West Hollywood when they met, and she is very business savvy, while also being a mother of 4 children. Although I have Frank's music in my home music collection, I didnt keep up with his music that much ... and never categorized him in any specific genre, nor did I know what to expect from him next as far as genre. His composition to me was very complex, and he had a large turnover as well of musicians that were working with him, but his composition was top line no doubt. I know that there was also conflicts of interests with several he worked with and how he ran things and lawsuits. Some of his stuff looked like it may be tough to rehearse with accuracy ... which makes me understand how he laid out their sets leaving open time gaps for him or others to highlight solos, skits or whatever that were spontaneous and not rehearsed. Which is also unique, instead of the conventional set of just going out with a set that is in stone and playing the same riffs to a tee with perfection, etc. Frank looked at it as a treat for the audience, and to make sure that no 2 shows were exactly alike ... which Frank sayz led to bootlegging live worx too. As far as guitar technique, he was well rounded, unconventional, and as Frank would put it ... specialized. He liked when Steve Vai was with him for a couple years (80- 82?), because he said that Steve would do everything on the guitar that he didnt do ... and Steve being so young said later that Frank's advice to him saved him millions of dollars.

I also want to credit his son Dweezil for preserving his dad's work and guitar technique, and teaching it to others, Dweezil does great guitar work himself. Lyrics is what really caught me about Frank too, his lyrics were out there and good humour mixed with truth. At the same time, his lyrics were criticized by some as being vulgar, sexist or anti-Semitic even, he received criticism from folks for "Bobby Brown" saying it was anti- gay or whatever. Yet, the Bobby Brown song was embraced by gayz worldwide and became a sort of classic played in gay nightclubs in Europe and America for years, and still to this day ... at least the gayz seen the humour, when others try to find something wrong with every song or piece of literature and art ... the song "Jewish Princess", the same thing getting heat from the Anti- Defamation League. Also I included a interview video below where Frank talks about the industry, what is was becoming back then, MTV and such ... much is even worse today. I had many musicians over the years tell me the heartaches and even some of the rip- offs they were up against in the industry ... and yes, it got to the point where your looks and dress becomes more importante than music for some looking for large labels and backing. This is why I support so many inde artists, and been doing it since around the late 1970's, because of what I myself seen. And I really admire folks like Frank that are D.I.Y producers, promoters, to starting their own label. Today it is getting much easier to do this and get success, because of the new technologies available to independents, internet to self promote and YouTube to showcase stuff, etc. Frank was able to take care of everything with Gail and really make a successful business and really call the shots on what they will produce and distribute while keeping as much big corporate dictation out of it as they can. Carolina Parrothead aka "Beach Bum"




This posting will serve as Part 50 of "The Awakening" series of this journal/ blog and as a Independence Day 2017 posting. Information and awareness without the usual politipop institutionalized thinking is alwayz an awakening to reality and an essential tool for liberation in my view. Carolina Parrothead is a blog that I frequent that brings up some good food for thought and covers a variety of topics. He goes by the nickname/ pen name of Beach Bum ... I out of habit call him "Bum", because that was my uncle's nickname everyone called him (actual name was Charlie ... my mom's brother), who was a favourite uncle of mine as a kid ... and a sort of black sheep, street smarts tough guy. Beach Bum served this country as US Army (retired) and is currently residing in South Carolina. After reading this, I thought it would be a fitting and excellent choice for this series, and an Independence Day posting that is a pretty straight up view of the condition past, present and future ... and Thanx to Beach Bum for the read.
